Our mission is to create an environment where learners can progress to their best of capabilities and help users to attain better opportunities. Protecting your privacy is fundamental to our mission. This Privacy Policy governs the use of Personal Information collected by our websites docsta.com or docstainstitute.com, the Docsta Applications, and any other online or offline offerings (collectively “the Docsta Service”, “the Service”, “platform”, “Docsta”, “we”, “us”, or “our”). This includes, for example, personally identifiable information that we collect when you create an account (“Account Information”), content added to class journals (“Journal Content”), courses that instructors create (“Activities”), and messages (“Messages”) sent via Docsta Institute. For the purpose of this privacy policy and all other situations, “Docsta” or “Docsta Institute” shall have the same meaning and might be used interchangeably.

Our privacy policy, copyright & intellectual property policy are further incorporated into this samedocument. By using the Services, you hereby agree to be bound by these Terms and any disagreement with the mentioned terms will render the services invalid for your use.

If the user is a the parent or teacher or legal guardian of a child who is under the age of 18, where they can legally enter into a contract or grant consent for processing of personal information, then, by using the Services, the concerned parent/guardian/teacher also accepts these Terms on the child’s behalf.

DESCRIPTION OF SERVICE

The Docsta Institute Service allows learners to find classes that they are interested in taking, and allows instructors to find learners interested in taking their classes.

We reserve the right to refuse to provide the Service to any person for any reason and/or to discontinue the Service in whole or in part at any time, with or without prior notice.


IN THE EVENT OF ANY CHANGES TO TERMS

We reserve the right to update our Terms from time to time at our sole discretion. If a change arises, we shall inform you know by posting the updated Terms to the Site, on the App, and/or may send other communications. The users can review the Terms when we update them.

In the event that the user continuesusing our services once the Terms have been updated, it is agreed that they have accepted the change to the Terms and consented to the same. If users don’t agree to be bound by the changes, then they may not use the Services further. As our scope of Services will be updating and evolving with time, we could change or discontinue all or any part of the Services, at any time and without notice, at our sole discretion.


CONSENTING ON BEHALF OF MINORS (BELOW THE LEGAL AGE OF 18)

If you are a teacher or an instructor, you warrant to Docsta Institute that prior to uploading any personal information of any child who is younger than 18 (or such other age as may be required under applicable law) onto the Services, you have obtained the legally binding consent of the parent or legal guardian of each such child.

Furthermore, you should consult with your school or district to ensure that you obtain proper consent to use the Services in the classroom consistent with your school or district’s policies.


CREATING A TEACHER ACCOUNT OR CLASS

Only instructors, teachers or school administrators are permitted to create a class on our online platform to use our Services on contacting us at Docsta in order to get approval to add in classes. Once the class is created, instructors can invite learners, additional faculty, parents, and guardians to the class. Docstareserves the control as to who can upload, view, comment on, and share student work and they can change these permissions at any time.

When you create a Docstaclass, you represent and warrant that:

  • Any additional instructors you add to your class are authorized by Docsta Institute team and has the consent to access Student Data
  • You will use Docsta Institute only for lawful purposes and you will abide by applicable laws of the country wherein it is used
  • You will treat Docsta Institute as an extension of a face to face classroom and ensure that learnersuseDocstaresponsibly

CREATING A STUDENT ACCOUNT

Learners may use Docsta website or app only if they are above age of 18 or if their parent or legal guardian has given permission to use online services. You agree to use the Services only if you have been given a Join Code or have otherwise been invited to use the Service.

On accepting these terms, all users agree to use the Services only for lawful purposes and abide by applicable laws of the country.


INSTRUCTOR’S COURSE CONTENTS

Instructors may choose to publish course/ programs that they create to the public community while agreeing that:

  • You are the copyright holder or you have explicit consent of the copyright holder, or you have a valid legal basis (for example, fair use) for posting any content you submit to Docsta platforms
  • You have secured permission to share the personal data of any person that is involved or included within your course/ program

Any courses you submit are yours and by publishing your program to the platform you understand that:

  • Your course will be publicly accessible unless you choose to remove it.
  • Your name and other activities will be visible as part of your profile.
  • Your activity may be shared by Docsta (for example on our website or in an email) and by instructors using the Services.
  • If you need to remove your courses, you will need to notify Docstaprior to discontinuation

CONSENT TO RECEIVE COMMUNICATIONS

On signing up for our Services, you agree to receive communications from Docsta, including text (SMS), email, and/or push notifications.

If a teacher or school administrator adds a student/parent to the program via phone number, on signing up, the students/parents agree to receive communications from Docsta.

Docsta is not responsible for your receipt of, or failure to receive any messages, or for messages sent erroneously or with incorrect information. Docstais not responsible for your or someone else’s action or failure to take action due to the receipt of any messages. If you make changes to your contact information, you are responsible for updating the same in your Account Settings


INTELLECTUAL PROPERTY

Our platform allows you to store or share content such as text, files, documents, graphics, images, music, software, audio, and video, which are referred to as “User Content”. Docstawill not be responsible for authenticity or IP infringement of content created by any external faculty other than the core team of Docsta.

We do not claim any ownership rights to any User Content. However, in order to provide our Services, we require certain limited rights to User Content. For example, when you upload your User Content, we must be able to store it and serve it back to users. Therefore, you grant Docsta a non-exclusive, transferable, worldwide, royalty-free license, with the right to sublicense, to use, publish, transmit, display, copy, process, adapt, modify, publicly perform, and distribute your User Content in connection with operating and providing the Services, but only within the context of the Services.

Instructors are solely responsible for all the Content they have created. By providing content to Docsta,instructors are committing that theyhave all rights that are necessary to grant Docsta, the rights to publish under these Terms. Instructors represent and warrant that the use or publishing of the Content by Docstaon or through the Services will not infringe, or violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.


DOCSTA’S INTELLECTUAL PROPERTY

All content on the Services that is not User Content, including but not limited to logos, trademarks, copyrights, domain names, or other distinctive brand features, blogs (collectively, “DocstaContent’) is protected by copyright, trademark, and other intellectual property laws and is the exclusive property of Docstaand its licensors.

Docsta Instituteprovidelearners a limited, non-exclusive, non-transferable license to view, copy, and display DocstaContent solely permitted in connection with use of our Services. Any rights, not expressly granted here are reserved. Unauthorized use of DocstaContent is prohibited. Learners agree not to remove, alter or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Services.

We will properly protect our knowledge generated through our business activities as intellectual property by acquiring intellectual property rights (patent rights, utility model rights, design rights, trademark rights, copyrights, plant breeders' rights, etc.) and managing trade secrets. We will use the Brand Logo and other trademarks appropriately and accurately in accordance with our standards. Recognizing that the company's brand and the intellectual property owned by the company are important assets of the company, we will use them appropriately and accurately in accordance with the laws, regulations and rules of the company in order to contribute to the development of society and the company. We will take strict action, including warnings and lawsuits, if our intellectual property rights, which are an important asset of our company, are infringed by a third party, such as patent rights infringement or counterfeiting. We respect the intellectual property rights of third parties, such as trademarks and patents, and will not use them without their permission. We will not damage or violate them. Recognizing that intellectual property laws and regulations differ in each country, we will pay particular attention to the registration, disclosure, transfer, use and licensing of intellectual property rights in each country.


COPYRIGHT POLICY

Docsta respects copyright law and expects its users to do the same. It is Docsta’s policy to terminate in all appropriate circumstances the account holders who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.

IF YOU SEE SOMETHING THAT INFRINGES YOUR COPYRIGHT

Docstaadopted the following policy toward copyright infringement. We reserve the right to

(1) block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members or users and
(2) remove and discontinue service to repeat offenders.


Procedure for Reporting Copyright Infringements. If you believe that material or content residing on or accessible through the Service infringes your copyright (or the copyright of someone whom you are authorized to act on behalf of), please send an email with all details to [email protected]

Identification of works or materials being infringed: Identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that Docstais capable of finding and verifying its existence;

Contact information about the notifier including address, telephone number and, if available, email address;

Once Proper BonaFide Infringement Notification is received by our team, after further verification, we reserve the right to:

Remove or disable access to the infringing material

Notify the content provider who is accused of infringement that we have removed or disabled access to the applicable material; and

Terminate such content provider's access to the Service if he or she is a repeat offender.

ACCOUNT TERMS

The following terms apply to your use of the Service and any account that you may open or attempt to open via the Service:

  1. You must be a human to open an account. Accounts registered by “bots” or other automated methods are not permitted.
  2. You are responsible for maintaining the security of your account and password. We view any actions taken by your account as taken by you. Docstawill not be liable for any loss or damage from your failure to comply with this security obligation.
CHANGING FEES

We reserve the right, at any time, to change any fees or charges for using any services provided on the Service (or to begin charging fees for any free service), provided that such changes will not apply to fees or charges paid or free services used prior to the time of the change.

RULES FOR ALL DOCSTA USERS

Docsta is an educational platform open to millions of learners. While you sign up for the Site, you agree to the following rules:

  1. You will use the Service only for lawful purposes and agree to not use the Service in any way that will infringe upon the use or rights of any other user.
  2. Your use of the Service is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the Service.
  3. You will not upload any copyrighted, trademarked, or proprietary materials on the Service without the expressed permission of the owner. You will not post any content that infringes on any patent, trademark, trade secret, copyright, right of publicity, or other intellectual property or proprietary right of any party.
  4. You assume full responsibility for the content of the Service offered.
  5. You understand that classes posted are publicly available to be viewed and accessed by any student.
  6. You agree that you will not engage in any behavior that constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as “spamming”), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
  7. You will not share content from the Service with anyone who is not properly licensed to access the content.
  8. You will not upload, share, post, distribute or otherwise partake in any behavior that is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates our rules or policies.
  9. You will not partake in any behavior that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.
  10. You will not share software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party.
  11. You will not impersonate any person or entity, including any of our employees or representatives.
  12. You will not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. Not all parts of the Service may be available to you or other authorized users of the Service. You shall not interfere with anyone else’s use and enjoyment of the Service. Users who violate systems or network security may incur criminal or civil liability.
SPECIFIC RULES FOR INSTRUCTORS

When you publish a class on the Site, you agree to the following rules:

  1. You will honor any enrollments through docsta.com, www.docstainstitute.comat the price and time listed in the Service, and not refuse enrollments or participation by any student for any discriminatory or other illegal reason.
  2. You grant us the right to place advertisements on your content at our sole discretion.
  3. Any content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material.
  4. You represent and warrant to Docsta that you are qualified to teach the classes that you list with the Service and that you will at all times conduct yourself in a professional manner and in compliance with all applicable laws.
  5. You understand that, if you teach a class, your learners will have the ability to post a review of this class. We cannot control the contents of any such review and will not be held responsible for any information or opinions that a user may include in any such review.
  6. You may choose to remove content from your class and will continue to own such content, but we will continue to have the right to use that content and to provide it to learners who have paid for or enrolled in your class.
  7. You grant us full ownership of any video content that we have filmed for you. It is at our sole discretion to remove, add, or edit that video content.
  8. You agree that you will not submit content to Docsta that violates the Docsta’s Community and Class Guidelines, which may be occasionally updated.
  9. Docsta reserves the right to, but is under no obligation, to delete the listing of any class at any time and for any reason.
SPECIFIC RULES FOR LEARNERS

When you enroll in a class on the Site, you agree to the following rules:

  1. You will accept all of the terms and conditions including the cancellation policy listed in the Service when you agree to enroll in or access a class on Docsta.
  2. You will follow all reasonable rules set by the instructor with respect to a class, and you will not take any actions to interfere with the instructor or any other learners in the class.
  3. You may access class content for your information and personal use only.
  4. You will not copy any materials or techniques for purposes of your own or others’ classes, or for interfering with any class or the teacher’s ongoing relationship with any learners participating in such class.
  5. Docsta/Docsta Institute reserves the right to delete or suspend your account if you violate any of our rules, or at any time and for any reason.
DATA POLICY

When a student takes a class on Docsta/Docsta Institute, we will share the student’s username and profile with the teacher for the purpose of teaching these learners on Docsta. By enrolling in a class on Docsta, a student grants to us permission to share that student’s information with the teacher. The teacher is required to respect the privacy of the student. The teacher has a limited license to use this information only for Docsta-related communications or for Docsta-facilitated transactions. The teacher may use that personal information for no other purpose, such as sending unsolicited commercial messages or unauthorized transactions. Without express consent from that person, you must not add any Docsta misuse any student’s personal information. Remember that you need to comply with all relevant legal rules when you use Docsta. This includes applicable data protection and privacy laws, which govern the ways in which you can use another Docsta user’s information.

Finally, we may collect demographic information about you, such as gender, race and ethnic origin. We usually collect and use this information on an anonymized basis. If you provide demographic information to Docsta, you do so voluntarily and Docsta will collect, store and use your demographic information in accordance with our privacy policy. We may use this type of data to analyze trends and assist us in understanding demographic patterns related to our community and new and existing products, programs, or services; to administer, analyze, and improve the content and functionality of the Site and Services; for marketing; and to gather demographic information about our user base as a whole. We utilize unstructured machine learning technologies to understand user behaviors and to provide user-specific recommendations and other personalization of the Site or Services experience.

TEACHING OR PARTICIPATING IN A CLASS

These Terms of Service and the Governing Documents are in addition to any agreements, releases or other documents (the “Class Agreements”) that a teacher and student may enter into in connection with a class, including any Class Agreements entered into through the Service. Learners and instructors are each responsible to the other for complying with the terms of the Class Agreements, but Docsta has no control over either party’s compliance. Among other things, Docsta cannot control (a) the provisions of the Class Agreements, (b) the accuracy or legality of the Class Agreements or (c) any party’s performance of its obligations under the Class Agreements. Accordingly, Docsta shall not be held responsible for any liability arising out of the Class Agreements or any actions that you may take in reliance thereon, and is not a party to any transaction between you and any other user. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE DOCSTA INSTITUTE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “DOCSTA INSTITUTE PARTIES”) FROM ANY CLAIMS OR DAMAGES OF ANY KIND OR NATURE, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, DISCLOSED OR UNDISCLOSED, RELATING TO ANY DISPUTE RELATING TO THE CLASS AGREEMENTS OR ANY TRANSACTION OR ATTEMPTED TRANSACTION WITH ANOTHER USER OF THE SERVICE (WHETHER A STUDENT OR TEACHER). YOU AGREE AND UNDERSTAND AND INTEND THAT THIS ASSUMPTION OF RISK AND RELEASE IS BINDING UPON YOU AND YOUR HEIRS, EXECUTORS, AGENTS, ADMINISTRATORS AND ASSIGNS.

Your teaching or participation in a class is at your sole risk. Docsta does not supervise classes and is not involved in any way with the actions of any individuals (whether learners or instructors) at any class. As a result, we have no control over the identity or actions of the individuals who are present at these classes, and we request that our users exercise caution and good judgment when participating in Classes. You acknowledge and agree that by participating in any class (whether as a student or teacher) you may be exposed to a variety of risks and hazards, which may or may not be foreseen, including (without limitation) personal injury, property damage and death. You are solely responsible for all costs and/or risks associated with your participation in any class.TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE DOCSTA INSTITUTE AND EACH OF THE OTHER DOCSTA INSTITUTE PARTIES FROM ANY CLAIMS OR DAMAGES OF ANY KIND OR NATURE, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, DISCLOSED OR UNDISCLOSED, RELATING TO YOUR PARTICIPATION IN ANY EVENT, WHETHER AS A STUDENT OR TEACHER. YOU AGREE AND UNDERSTAND AND INTEND THAT THIS ASSUMPTION OF RISK AND RELEASE IS BINDING UPON YOU AND YOUR HEIRS, EXECUTORS, AGENTS, ADMINISTRATORS AND ASSIGNS.

MEMBERSHIP FEES
  1. Docstacollects all fees and pays out all instructors through third party providers. Each provider is its own company, and Docstaisn’t responsible for its performance.
  2. No refunds are offered for membership fees or any other fees collected by the Service.
  3. Fees for membership or any other portion of the Service may be changed at any time without prior notice.
INSTRUCTOR PAYMENTS
  1. Instructors may earn revenue by publishing classes or offering additional services through Docsta. Payment/ share for the instructors will be predetermined according to the courses and must be agreed upon prior to usage of Docstaservices.
  2. Docsta pays instructors on the 16th of the month. Payouts sent on the 16th of each month are for transactions that have occurred in the previous calendar month.
  3. Monthly payouts begin the month following the month in which a teacher publishes their first class
  4. Docstadistributes a nominal amount as monthly recurring revenue from membership to DocstaInstructors on a monthly basis. The algorithm used to determine your monthly share is based primarily on your share of the total number of paid minutes watched on the platform. The specifics of the distribution calculation are subject to change from time to time.
  5. Instructors have 30 days from the time at which a payment was or should have been made to report any discrepancies.
  6. Instructors and learners agree that Docsta’s sole responsibility is to process payments and pay out instructors in the proportions set forth above. Docstais not party to any transaction between any student and/or teacher and cannot be held responsible for any issues arising from any such transaction.
  7. Instructors are responsible for all income, sales, and other taxes associated with the fees they earn. Instructors will be required to provide Docsta with appropriate tax documentation. Docstareserves the right to withhold any payment until it has received all tax identification information it requires to satisfy its obligations.
  8. Docsta reserves the right to withhold or cancel payments to Instructors if it deems, in its sole judgment and absolute discretion, that the Teacher engaged in behavior that violated any part of this Agreement.
THIRD-PARTY SERVICE PROVIDERS

The Services (including the App) may allow learners to access third-party websites or other resources, for example when a teacher includes a link to a learning or development activity througha YouTube video. Docstaprovides access only as a convenience and are not responsible for the content, products, terms or services on or available from those resources or links displayed on such websites. Learners acknowledge sole responsibility for and assume all risk arising from the use of any third-party resources.


PROHIBITED ACTIVITIES

Learners/Instructors agree not to do any of the following:

  • Post, upload, publish, submit or transmit any User Content that:Infringes, misappropriates, or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy;
    Violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability;
    Is fraudulent, false, misleading, or deceptive;
    Is defamatory, obscene, pornographic, vulgar, or offensive;
    Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group;
    Is violent or threatening or promotes violence or actions that are threatening to any person or entity;
    Promotes illegal or harmful activities or substances; or
    Is inappropriate for the society
    Jeopardize the security of user account in any way, for example by allowing someone else access to user account or password.
    Use, display, mirror, or frame the Services or any individual element within the Services, Docsta/Docsta Institute’s name, any Docsta/Docsta Institute trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Docsta’s written consent.
    Access, tamper with, or use non-public areas of the Services, Docsta’s computer systems, or the technical delivery systems of Docsta’s providers
    Attempt to probe, scan or test the vulnerability of any Docstasystem or network or breach any security or authentication measures
    Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Docsta or any of Docsta’s providers or any other third party (including another user) to protect the Services
    Attempt to access or search the Services or download content from the Services using any engine, software, tool, agent, device, or mechanism (including spiders, robots, crawlers, data mining tools, or the like) other than the software and/or search agents provided by Docstaor other generally available third-party web browsers
    Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters, or other forms of solicitation
    Use any meta tags or other hidden text or metadata utilizing a Docsta or Docsta’s Institute trademark, logo URL, or product name without Docsta’s express written consent
    Use the Services, or any portion thereof, for any commercial purpose or for the benefit of any third party or in any manner not permitted by these Terms
    Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Services to send altered, deceptive, or false source-identifying information
    Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Services
    Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services
    Collect or store any personally identifiable information from the Services from other users of the Services without their express permission
    Impersonate or misrepresent your affiliation with any person or entity
    Violate any applicable law or regulation or encourage or enable any other individual to do any of the foregoing.

Docstawill take measures to monitor, log, and block content that violate our policies. Docstais not obligated to monitor access to or use of the Services or to review or edit any content. However, Docstahave the right to do so for the purpose of operating the Services, to ensure compliance with these Terms, and to comply with applicable law or other legal requirements. Docstareserve the right but are not obligated, to remove or disable access to any content, including User Content, at any time and without notice, including, but not limited to, if we, at our sole discretion, consider it objectionable or in violation of these Terms. Docstahas the right to investigate violations of these Terms or conduct that affects the Services. Docstamay also consult and cooperate with law enforcement authorities to prosecute users who violate the law. To report violations of these policies, contact [email protected].

Docstadoes not validate the identity of any learners; the user may interact with in the course of using the Services. In addition, Docsta does not guarantee the authenticity of any information users provide about them.


ACCOUNT SUSPENSIONS AND TERMINATION

Docsta reserves the right to suspend or terminate accounts associated with users who engage in any of the prohibited activities described above or in any manner that otherwise violates these Terms or other policies. In addition, Docsta reserves the right to terminate any account at any time for any reason without notice to you.

If you would like to delete theDocsta account, contact [email protected]. If user requests that their account or any content submitted to Docsta be deleted, Docstamay still retain pertinent information that are needed to provide customer support and prevent accidental deletion, or as required or permitted by law.


ACCOUNT TRANSFER OF INSTRUCTOR

If an instructor has signed up as a teacher with a school-aided email address, and the instructor’s school, later signs up for a Docsta school account, Docsta may transfer instructors account to be under the management and control of instructors school. To protect Student Data, in certain limited circumstances (such as when a teacher leaves a school) Docsta may transfer a class to a different teacher if Docsta receive an authorized request from the relevant school.


ABANDONED ACCOUNTS

Docstawill permanently delete an account that has not been accessed by the account holder for more than five years, except where required to retain the information longer for legal or compliance purposes. Prior to permanently deleting an abandoned account, Docsta will attempt to notify the account holder by email.


PAYMENT BY USER

If auserenrolls to Docsta program, the user authorizesDocsta(or our third-party payment processor) to charge the user for such Transaction. Payment gatewaymay ask the user to supply additional information relevant to the transactions, including user’s credit card number, the expiration date of the credit card, and user email and postal addresses for billing and notification (such information, “Payment Information”). The user represent and warrant that the user has the legal right to use all payment method(s) represented by any such Payment Information. When the user initiates a Transaction, the user authorizesDocstato provide the Payment Information to third parties, so that Docstacan complete the Transactions and charge the payment method for the type of Transaction the userhave selected (plus any applicable taxes and other charges). The user may need to provide additional information to verify the identity before completing the Transactions (such information is included within the definition of Payment Information). By initiating a Transaction, the user agrees to the pricing, payment, and billing policies applicable to such fees and charges, as posted or otherwise communicated to the user. All payments for Transactions are non-refundable and non-transferable except as expressly provided in these Terms.

  1. Subscriptions. If the user purchase a Subscription, the user will be charged the Subscription fee monthly or annually, depending on the type of Subscription the user has selected, plus any applicable taxes, and other charges (“Subscription Fee”), at the beginning of the Subscription and each month or year thereafter, depending on the type of Subscription the user has selected.

Subscription Fee. BY PURCHASING A SUBSCRIPTION, THE USER AUTHORIZESDOCSTA TO INITIATE RECURRING NON-REFUNDABLE PAYMENTS AS SET FORTH BELOW. If the user purchases a Subscription, Docsta(or our third-party payment processor) will automatically charge the user each month or year, depending on the type of Subscription the user has selected, using the Payment Information the user has provided until the user cancelsthe Subscription. By agreeing to these Terms and electing to purchase a Subscription, the user acknowledges that the Subscription has recurring payment features and the user accepts responsibility for all recurring payment obligations prior to cancellation of the Subscription by themselves or Docsta. The user Subscription continues until canceled by the user or Docsta terminatesthe access to the use of the Services or Subscription in accordance with these Terms.

Canceling the Subscription. THE USER PURCHASE IS FINAL AND THE USER WILL NOT BE ABLE TO CANCEL THE PURCHASE AND/OR RECEIVE A REFUND OF THE SUBSCRIPTION FEE AT ANY TIME. But if something unexpected happens in the course of completing a Transaction, Docstareserve the right to cancel the Transaction for any reason; if Docstacancel the Transaction we’ll refund any payment the user has already remitted to us for such Transaction. Without limiting the foregoing, the user may cancel the Subscription at any time, but please note that such cancellation will be effective at the end of the then-current Subscription period. THE USER WILL NOT RECEIVE A REFUND OF ANY PORTION OF THE SUBSCRIPTION FEE PAID FOR THE THEN-CURRENT SUBSCRIPTION PERIOD AT THE TIME OF CANCELLATION. To cancel, the user can send an email to [email protected].The user will be responsible for all Subscription Fees (plus any applicable taxes and other charges) incurred for the then-current Subscription period. If the user cancels the subscription, theservices will continue until the end of the current Subscription period and will then terminate without further charges.

THE SERVICE AND ALL MATERIALS INCLUDED THEREIN ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY OF NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT (A) THE SERVICE AND MATERIALS WILL MEET YOUR REQUIREMENTS, (B) THE SERVICE AND MATERIALS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR MATERIALS WILL BE EFFECTIVE, ACCURATE OR RELIABLE, OR (D) THE QUALITY OF ANY CLASS THAT YOU ATTEND VIA THE SERVICE, OR ANY OTHER PRODUCTS, SERVICES, OR INFORMATION PURCHASED OR OBTAINED BY YOU FROM THE SERVICE FROM US OR OUR AFFILIATES WILL MEET YOUR EXPECTATIONS OR BE FREE FROM MISTAKES, ERRORS OR DEFECTS.

The Classes offered on Docstaare offered directly by the instructors. Docsta is not responsible or liable for any information on its Service listings or profiles. Docsta is not responsible for any changes made to a class by the teacher.

You understand and agree that temporary interruptions of the Service may occur as normal events. You further understand and agree that we have no control over third party networks you may access in the course of the use of the Service, and therefore, delays and disruption of other network transmissions are completely beyond our control.

You understand and agree that the Service is provided “AS IS” and that we assume no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.


INDEMNITY

The user agrees to indemnify and holdDocstaunaccountable for any claims, suits, actions, losses, costs, damages, and any other liabilities, including attorneys’ fees, arising out of or related to: (a) the use or misuse of Docsta; (b) any violation of the rights of any other person or entity by the user, including without limitation, any intellectual property right, publicity, confidentiality, property or privacy right; or (c) breach of any part of these Terms. Docsta will attempt to provide the user with written notice of any such matter; however, any failure or delay by Docsta to do so does not negate the user defense or indemnification obligations or waive Docsta’s rights to seek payment or defense or indemnification from the user. Docsta reserves the right, at the users expense, to assume the exclusive defense and control of any matter for which the user are required to indemnify us, and the user agrees to cooperate with Docstain our defense of these claims. The user will not settle any claim that affects Docsta Institute or our affiliates without our prior written approval.

On a request from us, you agree to defend, indemnify, and hold us and the other DocstaParties harmless from all liabilities, claims, and expenses, including attorney fees that arise from your violation of these Terms of Service or any of the other Governing Documents, or other negligent or wrongful conduct. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

Most communication between Docsta and you will be sent and received electronically. You agree that all electronic communication between Docsta and you shall satisfy any legal requirements that such communications be in writing.


LIMITATION OF LIABILITY

IN NO EVENT SHALL WE OR ANY OTHER DOCSTA INSTITUTE PARTY BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICE OR OF ANY WEB SITE REFERENCED OR LINKED TO FROM THE SERVICE.

FURTHER, NEITHER WE,NOR ANY OTHER DOCSTA INSTITUTE PARTY, SHALL BE LIABLE IN ANY WAY FOR ANY CLASS OR OTHER THIRD PARTY GOODS AND SERVICES OFFERED THROUGH THE SERVICE OR FOR ASSISTANCE IN CONDUCTING COMMERCIAL TRANSACTIONS WITH OTHER USERS OF THE SITE, INCLUDING WITHOUT LIMITATION ANY TRANSACTION BETWEEN A STUDENT AND INSTRUCTORS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCSTA WILL NOT BE LIABLE TO THE USER FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, RELIANCE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY DAMAGES FOR LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE SERVICES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR: (A) THE USER ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY ON THE SERVICES; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATIONS OF YOUR TRANSMISSIONS OR CONTENT; (D) ANY INFORMATION POSTED ON THE SERVICES; OR (E) DOCSTA INSTITUTE’S DECISION TO PUBLISH OR REMOVE ANY INFORMATION ON THE SERVICES; IN EACH CASE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT DOCSTA INSTITUTE OR OUR SERVICE PROVIDERS HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY THE LAW OF THE APPLICABLE JURISDICTION, IN NO EVENT SHALL DOCSTA’S TOTAL LIABILITY TO THE USER FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR FROM THE USE OR INABILITY TO USE THE SERVICES EXCEED: (1) THE AMOUNTS THE USER PAID TO ACCESS THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF YOUR CLAIM.

The limitations of liability set forth in this Section are fundamental elements of the basis of the bargain between the user andDocsta and will survive any termination or expiration of these Terms, and will apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose.
DOCSTA INSTITUTE RIGHTS

Docsta reserves these rights:

  • We can make changes to the Docsta Site and Services without notice or liability.
  • We have the right to terminate your membership, account, payment, or other affiliation with the Service at any time and for any reason. We can change our eligibility criteria at any time. If these things are prohibited by law where you live, then we revoke your right to use Docsta in that jurisdiction.
  • We will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.
  • We have the right to remove an instructor from the instructor title at any time, without prior notice, at our sole discretion, should we identify that their account is associated with behavior that we deem to be in violation of our rules or guidelines.
  • We have the right to reject, cancel, interrupt, remove, or suspend any class, comment, or other posted comment at any time and for any reason.

Docstais not liable for any damages as a result of any of these actions, and it is our policy not to comment on the reasons for any such action.

RECURRING BILLING TO USER

The membership fee will be billed on the beginning of the paying portion of your membership and each month or year thereafter unless and until you cancel your membership. We automatically bill your Payment Method each month on the calendar day corresponding to the commencement of your paying membership. We reserve the right to change the timing of our billing, in particular, as indicated below, if your Payment Method has not successfully settled. In the event your paying membership began on a day not contained in a given month, we may bill your Payment Method on a day in the applicable month or such other day as we deem appropriate. For example, if you started your membership or became a paying member on May 31st, your next payment date is likely to be June 30th, and your Payment Method would be billed to that date.

REFUND POLICY OF SUBSCRIPTION
Unless your subscription plan is offered with a 30-day money back guarantee, payments are nonrefundable and there are no refunds or credits for partially used periods, unless otherwise required by applicable law. You may cancel your membership in accordance with this Terms of Service.

If you purchased an annual subscription plan offered with a 30 day money back guarantee, you will be entitled to a full refund upon cancellation by contacting us to request a refund. Once your refund is confirmed, you will lose all access to your Docstamembership.

Docstahas no obligation to consider or grant refund requests (i) for subscription plans purchased with a 7-day or longer free trial; (ii) that do not occur within the first thirty (30) days of your membership or (iii) if there has been a violation of our Terms of Service or our Community Guidelines or fraud. You are entitled to one refund only. After your refund, any future subscriptions will no longer qualify for the 30-day money back guarantee.

CANCELLATIONS OF SUBSCRIPTIONS

You may cancel your Docstamembership at any time for any or no reason. To cancel your recurring subscription, please visit your payment settings within your Docsta Institute account profile located at https//www.docstainstitute.com/settings/payments . If you have canceled your Docstamembership, you will lose access to all membership Classes you enrolled into during your Docstamembership at the end of your billing period. If you choose to sign back up as a paying member, your billing date will reset to the day you paid.

IN THE EVENT OF FREE TRIALS

Occasionally we or others on our behalfmay offer trials of paid subscriptions for our Docstamembership for a specified period without payment or at a reduced rate (a “Trial”). Docsta reserves the right, in its absolute discretion, to determine your eligibility for a Trial, and, subject to applicable laws, to withdraw or to modify a Trial at any time without prior notice and with no liability, to the greatest extent permitted under the law.

For some trials, we will require you to provide your payment details to start the Trial. At the end of such trials, we may automatically start to charge you for the applicable paid subscription on the first day following the end of the trial on a recurring monthly or annual basis. When you provide a Payment Method, we will attempt to verify the information you entered by processing an authorization hold. We do not charge you in connection with this authorization hold, but your available balance or credit limit may be reduced. By providing your payment details in conjunction with the trial, you agree to this charge using such payment details. If you do not want this charge, you must cancel the applicable paid subscription through your payment settings within your account inDocsta’swebsite.

STUDENT REFERRAL PROGRAM

You may participate in our “Student Referral Program” by referring potential learners to the Service. Under the Student Referral Program, you will receive points for each Qualified Student Referral (as hereinafter defined), which can be redeemable in Docsta programs.

In order to receive a Student Referral Award, each of the following requirements must be met (any referral for which all such requirements are met hereinafter referred to as a “Qualified Student Referral”): (i) you must log in to your Docsta account on the Service and select the “Invite Friends” link; (ii) you must share the link provided with friends via Facebook, Twitter or similar services, by copying and pasting the Unique Referral Link generated via the Service, by sending the Unique Referral Link in an email via the Services to your friends, or by using the other tools provided by Docsta to share the Unique Referral Link with friends; and (iii) a friend who clicks the Unique Referral Link must create a Docsta account and successfully pay for a program.

We reserve the right to suspend your account and remove referrals should we notice any activity we determine as abuse of the referral program.

REFERRAL AWARDS REGULATIONS

Satisfaction of a Qualified Referral (as hereinafter defined) and the Referral Award (as hereinafter defined) you receive will be seen in your Docstaaccount in 30 days after the Qualified Referral has been completed. The Referral Awards you accruecan beseen in your Docsta account referrals page. Referral Awards can be accrued solely by you and you may not earn Referral Awards by permitting another individual to use your Docstaaccount. You may not earn Referral Awards by creating multiple Docstaaccounts.

For purposes hereof, a “Qualified Referral” means a Qualified Student Referral, and a “Referral Award” means a Student Referral Award.

We reserve the right to suspend your account and remove referrals should we notice any activity we determine as abuse of the referral program.


GOVERNING LAW AND DISPUTES

These Terms and any action related thereto will be governed by the laws of the State of Kerala, without regard to its conflicts of law provisions.

RETAIL TRAINING (OFFLINE COURSES)

  • Training Services: Upon the confirmation of the training course and acceptance of this Agreement, Docsta Institute shall register you for the training that you have selected. All trainings will be conducted on the mutually agreed date and time. You are strictlyprohibited from recording any training provided by Docsta Institute.
  • Technical Requirements: All software/ development/ technical training courses requires trainees to have a laptop that is capable of connecting to the Internet, and such laptop must run Windows XP SP3 or Windows Vista or Windows 7, with Windows Remote Desktop Connection software and a current version of a web browser (Internet Explorer, Mozilla Firefox or Google Chrome). The prerequisite software licence (free software) is covered in the training. Paid versions of software licences are not covered in course fees.

  • It is not allowed to exclude the copyright notice of Docsta on all entire or partial copies you may make of the Training Materials or Documents on any medium;
  • Do not provide or otherwise make available the Training Materials or Documentation in whole or in part, in any form to any person without prior written consent from the Licensor
  • Post Training: Trainees are entitled to have 14 days email support from the trainer to help with any post-course issues.

  • All quotations are valid one month from the date of quotation. Thereafter, prices shall be revised.
  • All quotations are not Pro-Rata basis, i.e, If the number of participants attending the session is less than the quoted number of pax, the price remains the same.
  • Confirmation of registration is based on receipt of a Purchase Order or Registration Form.
  • Payment must be made prior to course commencement. Payments can be settled through,
  • Bank Transfer
  • Cash Payment
  • Credit Card
  • Cheque
  • Cancellations or Postponement Policy
  • Cancellation or Postponement Policy. The following charges will apply in case of cancellation:
  • 15 days prior to the commencement of the training date - No charge
  • 6 to 14 days prior to the commencement of the training date - 50% of the total invoice value
  • Less than or equal to 5 Days prior the commencement of the training date – 100% of the total invoice value

INFORMAL DISPUTE RESOLUTION

Docstawants to address the users concern without litigation or other formal proceedings. Before filing a claim against Docsta, the user agrees to try to resolve the Dispute informally by contacting [email protected] and providing us with reasonably detailed information concerning the issue. Docstawill try to resolve the Dispute informally by contacting the user through email. If a dispute is not resolved within 45 days after submission, the user or Docsta may bring a formal proceeding in accordance with these Terms.


FEEDBACK

Docstawelcomesthe feedback and suggestions about the Services. Please email us at [email protected]at any time. If the user chooses to submit feedback, the user agrees that Docstaare free to use it without any restriction or compensation to the user.


ENTIRE AGREEMENT

These Terms (and any other policies we refer to in this document) make up the entire agreement between the user and Docsta institute LLC., and supersede any prior agreement. If any parts of these Terms are found to be unenforceable by a court or arbitrator, the remaining parts will remain in full force and effect. If Docsta fails to enforce any part of these Terms; such a failure does not constitute a waiver. The user may not assign or transfer these Terms, by operation of law or otherwise, without Docsta’s prior written consent. Docsta may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
